We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time you access our  website you read these terms and conditions.

Our Website Products and Services


1. Our products and services are provided to adults over the age of eighteen (18) years.  By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.

Product Descriptions


2. We strive to ensure that our products are described as accurately as possible on our website, however we do not warrant that the description is accurate.  We reserve the right to correct any error or omission when we become aware of such error or omission.  We shall endeavour to make the appropriate corrections as soon as possible, to avoid any inconvenience. 

3. Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflector portray the full design or options relating to that product.

Product and Service Orders


4.  Any prices mentioned on this website for Hot Chocolate Coaching products & services are in Australian Dollars (AUD) unless otherwise indicated.  Orders for Australian residents areinclusive of GST (Goods & Services Tax).  International orders are not subject to GST (lucky you!). 

5.  We endeavour to ensure that our pricelist is current.  We reserve theright to amend our prices at any time. If you have placed an order, we undertake to fulfill your order at the price listed at the time you ordered.

6.  All pricing and product queries related to Non-Hot Chocolate Coaching products that are sold via a third party, must be directed to the appropriate third party's website.  We are not responsible for product descriptions, product orders, or product pricing for products you purchase through a third party. Thanks for understanding.

7. We endeavour to ensure that the Hot Chocolate Coaching product and services list is current however we give no undertaking as to the availability of any Hot Chocolate Coaching product or service advertised on our website.  Of course, we aim to keep you happy and will do our best to make sure everything is available to you!

8. Hot Chocolate Coaching products and services are provided in digital format,  therefore packaging and postage charges are not applicable. 

9. When you order from us, you will be directed to PayPal to arrange payment.  You can make a transaction either through your PayPal account or by credit card.  When you are directed to the PayPal website, you will be required to provide your details to complete your order.  We receive your details from PayPal.  We undertake to take due care with this information, however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.

10. If a product or service is either unavailable or temporarily unavailable, your order may be rejected.  We undertake to accept or reject your order within Seven (7) days.  We will notify you as soon as possible if your order is rejected, however if for some reason we have not responded to you within Seven (7) days, it means that your order is rejected.     

11. Delivery of your ordered product or service will be as set out on our website under the description for that product or service. Title in the goods passes to you when we have received payment. Our terms of payment are set out on the order page.

12. All risk of loss or damage to the goods passes to you when we despatch the goods. 


Order Cancellation Due To Error

13. Where a Hot Chocolate Coaching product or service is listed at the incorrect price or within correct descriptive information or image due to typographical error or similar oversight, we reserve the right to cancel a transaction.  Where your credit card is charged, we will refund your credit card for the total amount debited through the PayPal system as soon as we become aware of the error.

Product Returns and Refunds


14. Hot Chocolate Coaching products sold on this website are of a digital nature, therefore physical return of the products are not applicable.  Refunds are available as described under the Guarantee section listed on the applicable product description page and as listed in Clause 15 below.

15. If you are having any trouble downloading a digital product, please inform us via our 'Contact Us' page and provide us with a valid proof of purchase from Paypal.  We will endeavour to rectify the problem as soon as possible for you.  If we are unable to rectify the problem and thus not be able to deliver your digital product, we undertake to reimburse you for the total amount of the purchase price where the product is a single product purchase and not part of a fully paid series or program.   

16. If the product is part of a fully paid series or program, we will reimburse you for the portion of the series or program pertaining to that particular product.  Example only - if you have purchased a series or program containing 5 downloadable products, and one of those downloadable products does not work and we are unable to rectify theproblem, you will be reimbursed for 1/5^th of the total purchase price. 17.  Refunds are available for Hot Chocolate coaching services as described under the Guarantee section listed on the applicable coaching services page of this website.

Site Access


17. When you visit our website, we give you a limited licence to access and use our information for personal use.

18. You are permitted to download a copy of the information on this website to your computer for your personal use only, provided that you do not delete or change any copyright symbol, trade mark or other proprietary notice unless specifically expressed otherwise on this website. Your use of our content in any other way infringes our intellectual property rights.

31. To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the goods and/or services again or payment of the costs of having those goods and/or services supplied again.

Force Majeure


34. If a Force Majeure event causing delay continues for more than Thirty (30) days, we may terminate this Agreement by giving at least Seven (7) days Notice to you. "Force Majeure" means any act, circumstance, or omission over which we could not reasonably have exercised control.

Jurisdiction

These terms and conditions are to be governed by and construed in accordance with the laws of Queensland, Australia.  Any claim made by either party against the other which in any way arises out of these terms, conditions will be heard in Queensland, Australia, and you agree to submit to the jurisdiction of those Courts.

36. If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

Privacy


37. We respect your privacy and will not rent, sell or trade your personal details.  We undertake to take all due care with any information which you may provide to us when accessing our website.  However, we do not warrant and cannot ensure the security of any information, which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
